Click2Bite

Terms of Service — United States

Last updated: October 29, 2026

1. The service and its provider

Click2Bite provides subscription tools to publish menus or catalogues, receive orders and help businesses (restaurants, bakeries, florists, shops and others) manage them. Each business sells and prepares its products. Click2Bite does not sell those products, operate the businesses or provide couriers.

2. Orders, prices and fulfilment

The business sets its menu, availability, prices, taxes, hours, estimated preparation times, delivery area and fees. Before paying, the store shows which business is selling, and the customer must review items, quantities, fulfilment method, address, discounts, charges and total. Pickup requires no courier; delivery is available when provided by the business’s own team. Times are estimates and may change with workload.

3. Payments and taxes

Orders are charged to the business’s account through Stripe. Stripe applies its own fees, terms and deposit schedule. Payment methods depend on the device and provider availability. The business sets its prices and any sales tax that applies in its state, and is responsible for its receipts, tax obligations and chargebacks. The customer sees the total with tax, delivery and tip before confirming payment and pays no additional fee to Click2Bite.

4. Issues, cancellations and refunds

For changes, missing items, delays or cancellations, contact the business using your order details. Cancellation depends on order progress and applicable law. If the business does not accept within its configured time, the system rejects the order and initiates an automatic refund. Removing a paid item initiates the corresponding refund. Posting time depends on the processor and bank; initiation does not mean immediate receipt. Use our contact form for platform assistance. These terms do not limit your consumer rights.

5. Accounts and business staff

Business accounts are for people aged 18 or over who are authorised to contract on behalf of the business. The account holder must provide accurate information, protect access and assign appropriate staff permissions. Use the kitchen code connection on shared tablets instead of the owner’s session. The business must monitor orders and keep its kitchen screen open, connected and with sound enabled. Ordering may pause when configured to do so and no kitchen is connected.

6. Subscription, plans and fees

The business pays the monthly or annual plan it chooses, in the currency and with the taxes shown before subscribing. There are three plans: Essential (one location with the business online, menu or catalog and QR code, “Order direct”, unlimited pickup and delivery orders, direct payments, an order screen, daily and weekly stats, live tracking with trip packs and a small “Made with Click2Bite” badge on the store), Pro (everything in Essential plus a loyalty card, promotions, “We miss you” reminders and the customer list, a driver map and full reports, without the badge) and Chain (everything in Pro for up to three locations, billed together, with one link for the whole brand and a loyalty card valid at every location). Pro and Chain include 100 live tracking trips per month per location; unused trips do not roll over to the next month. Any plan can buy trip packs. The loyalty card and coupons are the business’s promotions: the business sets the gift, its conditions and validity, and is responsible for them to its customers. “We miss you” reminders are sent by the business from its own WhatsApp; Click2Bite does not send messages to its customers. Prices, user and location limits and each plan’s features appear on the pricing page and in My plan. The annual plan is charged once a year, at the price shown when subscribing. The plan can be changed from My plan: with an active subscription, moving up charges the prorated difference for the current period that same day, and moving down leaves the prorated difference as a credit for the next charges; during the free trial a change does not generate a charge. Click2Bite takes no percentage commission on sales. For each online order it charges a flat fee that depends on the country (in the United States, US$1), which the payment processor sets aside automatically from the same charge. By using the service, the business authorizes that fee. In the United States customers do not pay this fee: the business covers it in full. The current fee for its country appears on the pricing page and in My plan. If an order is fully refunded, the fee is returned; if only part is refunded, it is kept (with Mercado Pago it is adjusted proportionally). Tax receipts for these fees are issued as required by applicable law. Locations linked to a Chain plan depend on the main account’s plan. In Mexico, the Pro and Chain plans include a printed kit of 100 “Order direct” labels with the business’s logo per location, shipped once to the main location: on the annual plan, after the first annual charge has gone through (when the free trial ends); on the monthly plan, after three monthly charges have gone through. The annual plan also includes assisted setup. Every plan includes the same labels as PDFs to print.

Live tracking included with deliveries. In Mexico, Brazil, Colombia, Peru and Uruguay, delivery orders from businesses with tracking included (always on the Essential plan; on Pro and Chain unless they turn it off) show the customer where their driver is. Trips included in the plan or bought by the business are used first, at no cost to the customer; if there are none, the customer pays a tracking charge shown in their total before paying (in Mexico, MXN 3), which the payment processor sets aside from the same charge for Click2Bite together with the per-order fee. If the trip could not be shown, the charge is refunded to the customer and Click2Bite returns its share to the business; with Mercado Pago, the refund is split proportionally between the business and Click2Bite. The current charge for each country is shown on the tracking page of the dashboard.

7. Free trial and renewal

The trial lasts seven days and applies to each business’s first eligible registration. During the trial every Pro plan feature can be used, even if Essential was chosen, except the included live tracking trips: during the trial, live tracking and the driver map are paid with trip packs or the map pass. User, location and photo storage limits are those of the chosen plan. Activation requires a card registered with Stripe. At the end, the chosen plan applies with its features and limits, is charged automatically and renews for its contracted period unless cancelled beforehand. Review the amount, period and billing date during subscription and in My plan.

Before activating the trial or subscribing we show you the amount and currency, the period, the first charge date, that the plan renews automatically and how to cancel, and we ask you to accept it with an unticked box; we keep a record of what you accepted and email it to you. We email you before each automatic charge: at least 5 calendar days before the trial ends and before each monthly renewal, and 30 days before each annual renewal, with the amount, the date and how to cancel without penalty.

8. Cancel your subscription

You can cancel in one step, online and without penalty, from My plan → “Cancel my plan”, with no calls or other steps. Cancellation takes effect immediately: from then on the plan no longer renews or charges, and it stays on until the end of the trial or the period you already paid for. We email you a confirmation with the cancellation code, the request date and the date the plan ends; before that date you can keep your plan. If you can't sign in or something fails, write to [email protected] and we'll record it. Cancelling does not by itself refund periods already billed; contact us about billing disputes, errors or refund requests. Refunds and other rights required by applicable law will be respected.

Automatic renewal (United States): by subscribing you agree that your plan renews automatically every month or every year, at the price shown, until you cancel. You can cancel online at any time from My plan. We send you a confirmation of what you agreed to, notices before each charge and, if the price changes, advance notice. We don't use offers or extra steps to block or delay your cancellation.

9. Non-payment, pause and data deletion

If the subscription charge fails or the plan is left without a current payment, the store keeps taking orders for 7 calendar days. From day 8 the store is paused: it stops taking orders and the dashboard only lets you into My plan to pay, download your data, get help and sign out. We will email the account holder at 30, 60 and 83 days without payment, with the days left and the exact deletion date. If the account is still unpaid at 90 days, we will delete the information of the account and all its locations (menu, photos, promotions, customer list, customers’ personal data in orders, users and connections to other services) and the online store will be taken down. We will keep only what we are required to keep, for the period the law requires: the tax and accounting records of orders and charges (amounts, taxes, dates and numbers), any tax receipts and the audit log. Before deletion you can download your data from My plan. If you pay before then, everything goes back to normal automatically.

10. Google Maps and external services

The business may add its ordering link to its Google Business Profile. Google decides availability, presentation and when to show the button. Click2Bite does not guarantee visibility, ranking or an order count. You can also share the menu by link and QR. Payment, map and notification services have their own terms and may experience outages. Click2Bite is not affiliated with Google.

11. Menus, promotions, stickers and music

The business must have rights or permission to use its texts, photos, logos, promotions and audio. It must keep product, price and allergen information accurate and clearly define promotional conditions. Order notes do not replace confirming an allergy directly with the business. QR stickers are a promotional tool; their use must respect third-party agreements and local rules.

12. Privacy and data

The privacy notice explains what data is used and how to exercise the rights of access, rectification, cancellation and opposition. Each business is the controller of its customers’ data and Click2Bite is its processor: we only process the data to provide the service and according to its instructions; we keep it confidential; we apply the security measures described in the notice; we only use the providers listed there; we help the business answer its customers’ requests and tell it without delay about any breach affecting them; and when the service ends we delete the data as described in section 9, except what the law requires us to keep. The business must restrict access to authorised staff, send reminders and promotions only to customers who allowed it at checkout (the “I want…” box) and stop when they withdraw it, and not use order data for incompatible purposes or for communications without the permission required by law. You can read the notice and submit requests from this site.

Click2Bite's obligations as processor and the business's obligations as controller are set out in the Data Processing Addendum, which is part of these terms and the business accepts at sign-up. Cookies and browser storage are explained in the Cookie Policy.

In the United States, reminders and promotions from the business may only be sent to customers who opted in at checkout, and the business must comply with applicable messaging laws (such as the TCPA) and promptly honor any request to stop receiving messages.

13. Permitted use and suspension

Fraud, fake orders, unlawful content, unauthorised access and actions that harm the service are prohibited. Access may be restricted to protect accounts, address breaches or comply with law. Where possible, we will explain the reason and provide a way to resolve it; urgent incidents may require action first. Non-payment is governed by section 9.

14. Availability and responsibilities

We work to maintain the service and fix failures, but cannot guarantee uninterrupted availability or freedom from errors. Businesses should have an alternative way to serve customers during connectivity or service outages. Responsibilities are determined under applicable law; these terms do not exclude mandatory obligations or liability that cannot legally be limited.

To the extent permitted by law, the service is provided “as is” and “as available”, without implied warranties of merchantability or fitness for a particular purpose. Click2Bite is not liable for indirect, incidental or consequential damages or lost profits, and its total liability to a business for claims related to the service is limited to the amount that business paid Click2Bite in the 12 months before the claim. The business is responsible for, and will indemnify Click2Bite against, claims arising from its products, prices, taxes, content, deliveries and legal compliance. Nothing here limits liability that cannot be limited by law or any consumer’s rights.

15. Changes and enquiries

Changes are published here with their date. Material service or contractual changes will be communicated through available channels before taking effect where required; renewed acceptance will be requested when needed. For assistance, complaints or enquiries write to [email protected] or use Contact or Help and support in your dashboard. Your country’s mandatory rules and consumer rights remain applicable.

16. Governing law and who provides the service

Click2Bite is provided by Click2Bite.

Nothing in these Terms limits the protection your state’s consumer laws give you. Before starting any claim, please contact us so we can try to resolve it informally within 30 days.
